During Anderson County Council meeting on July 15, Ms. Cindy Wilson plans to introduce the following ordinance:
“No County Council representative may be employed by the Administrator in any capacity for one year upon leaving office. No person who has served on County Council can receive any consulting contracts for one year upon leaving office. No person serving on Council can receive any County contract for one year on leaving office. Hardship matters can be presented to Council by the Administrator for appeal.”
Ms. Nancy Bloodgood, the County Personnel Attorney, made the following response:
“I understand that Ms. Wilson has proposed an ordinance that would prohibit a county administrator from hiring as an employee any person who has previously served on County Council for the period of one year. County Council is without authority to pass such an Ordinance, and if such an Ordinance is passed, it will violate State law. I strongly advise against Council enacting any ordinance that interferes in any manner with an administrator’s statutory hiring and discharge responsibilities.”
A Legal Professional expressed the following view:
“Although I think that Ms. Cindy Wilson is one of the meanest &*# I have ever observed, I do not think that her proposal is illegal. The County Council has the right to set the policy for hiring, and not hiring a former Council member for a year following his leaving of office is a matter of policy.”
